By using our website or placing an order, you agree to these Terms & Conditions.

Eligibility

To order through this website, you must be at least 18 years old and legally able to enter into a binding contract.

Orders, acceptance, and cancellations

Each order placed is an offer by you to purchase products subject to these Terms.

We may accept your order by sending an order confirmation and/or by shipping your order. We may decline or cancel an order for reasons including (without limitation) product availability, payment issues, inaccurate address information, suspected fraud, or unexpected limits on production/fulfillment resources.

If we cancel an order before shipment, we will refund amounts paid for the canceled items.

Product nature: preserved botanicals and natural variation

Speaking Roses products may include preserved botanicals (such as roses and petals) and customized printing.

Because these are natural materials, you acknowledge and accept that:

  • Shape, size, texture, and petal pattern vary naturally

  • Color may vary due to screen settings, lighting, photography, and natural variation

  • Printing on natural surfaces may show minor variation in placement and appearance

These variations are normal and not considered defects.

Customization rules (NO proofs/mocks)

We do not provide proofs, mocks, or manual review of your customization.

When you use our customization engine, what you submit and approve on-screen is what will be produced. This includes (without limitation) spelling, punctuation, capitalization, nicknames, inside jokes, dates, and layout choices.

You are solely responsible for confirming your customization is exactly as you want it before placing the order. Because customized items are produced exactly as submitted, we do not change, edit, or correct customization content after the order is placed.

Customer-provided content and rights

If you submit any names, logos, images, artwork, or other content, you represent and warrant that:

  • you have the legal right to use it, and

  • it does not violate any third-party rights (copyright, trademark, privacy, etc.)

You grant us a limited license to use that content only to produce and fulfill your order and provide customer support.

Availability and substitutions

Products are subject to availability. If we cannot supply a product, we will inform you and refund amounts paid for the unavailable item(s).

Because botanicals are seasonal and supply can fluctuate, we may occasionally need to substitute with an item of similar style, size, and value (for example, a comparable shade or variety). If the substitution is material, we may contact you for approval when reasonably possible.

We are not responsible for compensating you for any other losses you may incur if we do not supply goods beyond what is required by law.

Pricing, taxes, and pricing errors

Prices are shown at checkout at the time you place your order and exclude shipping unless stated otherwise.

We reserve the right to correct pricing errors. If a product is listed at an incorrect price, we may cancel the order or contact you with the correct price and give you the option to proceed or cancel.

International orders: Prices shown are in the United States. You are responsible for any customs duties, import taxes, VAT, brokerage fees, or similar charges assessed by your country or carrier.

Payment

Payment is due at checkout unless otherwise agreed in writing. You own the goods only after we receive payment in full.

Processing time, shipping, delivery, and carrier delays

We ship orders using third-party carriers (e.g., UPS, USPS, FedEx, DHL or other providers depending on destination).

Processing time: Orders placed before 11:00 AM Mountain Time typically ship the same day or within 24 hours(excluding weekends/holidays and peak seasons). This is an estimate and not a guarantee.

Carrier delays: Delivery timelines are based on carrier schedules. We are not responsible for delays caused by carriers, weather, customs, or other events outside our control.

Address accuracy: You are responsible for entering a complete and accurate delivery address. We are not responsible for delay or loss due to incorrect or incomplete addresses provided by you.

Risk of loss: To the maximum extent permitted by law, risk of loss passes to you when the shipment is tendered to the carrier.

Damaged, defective, or incorrect items

If your order arrives damaged, defective, or incorrect, you must contact us at csupport@speakingroses.com:

  • preferably within 48 hours of delivery, and

  • no later than 7 days after delivery

Please include your order number and clear photos/video of the product and packaging.

If your claim is approved, we will work with you to provide a resolution, which may include (at our discretion and as permitted by law) a replacement, reprint, or refund.

Returns and refunds

Because many of our items are customizedall customized products are final sale and not eligible for return or refund unless they arrive damaged, defective, or incorrect due to our error.

Non-custom items (if offered) may be eligible for return within 7 days of delivery if unused and in original condition. Shipping charges are non-refundable unless required by law.

Refused packages, return-to-sender, rerouting, and reshipment (standard clause)

If a shipment is refusedreturned to senderundeliverable, or requires address correction/rerouting due to customer-provided address issues or recipient unavailability:

  • the customer is responsible for carrier fees, return fees, address correction fees, and/or reshipment charges; and

  • refunds (if any) may be reduced by the actual costs incurred (shipping, return shipping, carrier fees, and handling); and

  • customized items may not be eligible for refund if returned for these reasons, except where required by law.

Events beyond our control (force majeure)

We are not responsible for delays or failure caused by events beyond our reasonable control, including natural disasters, severe weather, pandemic/epidemic, war, terrorism, government actions, labor disruptions, supplier failures, carrier delays, customs delays, or power/utility outages.

If an event outside our control substantially delays fulfillment, we will contact you when reasonably possible and work to minimize the impact. Where appropriate, you may be eligible to cancel and receive a refund for products not shipped.

Care, safety, and allergy notice

Preserved botanicals are intended for decorative use. Some individuals may have sensitivities or allergies to botanical products. If gifting, please confirm with the recipient if needed.

Intellectual property

All website content, product photography, designs, videos, text, trademarks, and branding are owned by Speaking Roses Global Inc. or its licensors and are protected by intellectual property laws. Unauthorized commercial use (including listing our images on third-party marketplaces) may result in legal action.

Limitation of liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or punitive damages.

  • Our total liability for any claim related to an order will not exceed the amount paid for the product(s) giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing law and venue (Utah / Davis County)

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles. Any disputes will be brought in the state or federal courts located in Davis County, Utah, and you consent to jurisdiction and venue there.

Changes to these Terms

These Terms may be updated at any time without prior notice. The version posted on the website at the time of purchase applies to your order.
